Welcome to VinShik. These Terms and Conditions govern your use of the VinShik service provider platform, website, and related services. By creating an account or using the platform, you agree to these Terms.
1. Acceptance of Terms
You must read and accept these Terms before using the platform. If you use VinShik on behalf of a business or team, you confirm that you have authority to accept these Terms for that business.
2. Services Provided
VinShik offers:
- A platform for service providers to create profiles and manage their service operations.
- Tools for managing customer details, service history, AMC plans, expiry dates, reminders, bills, reports, and WhatsApp communication.
- Tools for growing teams to assign work to technicians, track service activity, manage expenses, and view business performance.
- VinShik may add, change, suspend, or discontinue platform features at any time.
3. Eligibility
To use our services, you must:
- Be legally able to enter into a binding agreement.
- Provide accurate, current, and complete account and service information.
- Comply with all laws, licenses, permits, and professional requirements applicable to the services you provide.
4. Accounts and User Responsibilities
- You are responsible for protecting your login credentials and for activity under your account.
- Providers must keep their service descriptions, pricing, availability, location, and contact details accurate.
- Users must communicate respectfully, keep service records accurate, and promptly update customers about service changes or problems.
- You must not impersonate another person, create misleading profiles, or use the platform for unlawful or unsafe activities.
5. Bookings, Fees, and Payments
- Subscription prices and plan features will be shown before purchase and may vary by plan, billing period, or applicable taxes.
- Providers are responsible for the services they deliver, the accuracy of bills and customer records, and any applicable taxes, licenses, or statutory obligations.
- Payment processing may be handled by third-party providers and may be subject to their terms.
- Subscription upgrades, cancellations, refunds, and adjustments will follow the applicable plan terms presented at purchase.
6. Customer Records and Service Operations
- VinShik provides tools for managing a provider's existing customer relationships and service operations. VinShik is not the service provider or employer for services managed through the platform.
- Providers are responsible for obtaining appropriate consent to store customer details, service history, AMC information, billing records, and communication preferences.
- Providers are responsible for confirming service details, technician availability, prices, bills, reminders, and the quality and safety of their services.
7. Reviews and Content
- You must ensure that photos, descriptions, reviews, and other content you submit are accurate and do not infringe another person's rights.
- By submitting content, you give VinShik permission to host, display, and use it to operate and promote the platform.
- VinShik may remove content or reviews that are unlawful, misleading, abusive, or inconsistent with these Terms.
8. Code of Conduct
You agree not to:
- Share offensive, illegal, fraudulent, discriminatory, or misleading content.
- Use the platform to harass, threaten, defraud, or harm another person.
- Attempt to bypass platform security, scrape data, introduce malicious code, or disrupt platform operations.
- Violation of this section may result in suspension, termination, or legal action.
9. Intellectual Property
VinShik and its licensors own the platform, brand, software, design, and original content. You may use the platform only for its intended purpose and may not copy, modify, sell, reverse engineer, or distribute any part of it without written permission.
10. Limitation of Liability
VinShik is not liable for:
- Any indirect, incidental, special, or consequential damages.
- Technical disruptions or third-party service failures.
- Actions, omissions, quality, safety, or outcomes of providers or customers.
- Losses arising from inaccurate information supplied by another user.
11. Modifications to Terms
VinShik may revise these Terms from time to time. All updates will be posted on this page with a revised effective date. Continued use of the platform implies acceptance of the updated Terms.
12. Termination
We reserve the right to suspend or terminate any user account that violates these Terms or misuses the platform.
13. Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.
